TERMS AND CONDITIONS OF USE – TRADERPILOT

1. SOFTWARE LICENSE

The Company grants the User a limited, non-exclusive, non-transferable and revocable license to use TraderPilot software exclusively for personal or internal commercial use.

The User may NOT:

• Resell, sublicense or distribute the software
• Share accounts or credentials
• Reverse engineer, decompile or modify the software
• Use the software for illegal or unauthorized purposes

2. USE AT YOUR OWN RISK

• The User acknowledges that trading involves high financial risk.
• Use of TraderPilot is at the User's sole responsibility.
• The Company does not guarantee results or profitability.

3. NOT FINANCIAL ADVICE

TraderPilot does not provide financial, legal or investment advice. All trading decisions are the sole responsibility of the User.

4. DISCLAIMER OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

• Financial or capital losses
• Incorrect or failed orders
• Slippage or execution differences
• Violations of broker or prop firm rules
• Account suspension or closure
• Technical failures, bugs or software errors
• Connectivity or latency issues
• Third-party failures (APIs, brokers, platforms)

5. LIMITATION OF LIABILITY

THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER IN THE LAST 30 DAYS.

6. INDEMNIFICATION

The User agrees to indemnify and hold the Company harmless from any claim arising from:

• Use of the software
• Breach of these Terms
• User's trading activity

7. THIRD-PARTY SERVICES

TraderPilot may integrate with services such as TopStep and other brokers or APIs. The Company does not control and is not responsible for such services.

8. BROKER AND PROP FIRM COMPLIANCE

The User is responsible for complying with all applicable rules. The Company does not guarantee compliance or prevent sanctions.

9. SUBSCRIPTIONS AND PAYMENTS

• TraderPilot operates through recurring subscriptions
• Payments are processed through third parties such as Stripe
• Subscriptions renew automatically
• The User may cancel at any time
• No refunds are offered, except where required by law

Access may be suspended if payment fails.

10. TERMINATION

The Company may suspend or cancel User access at any time, including for:

• Violation of these Terms
• Misuse of the software
• Suspected fraud or abuse

11. INTELLECTUAL PROPERTY

TraderPilot, including its software, code, design and brand, is the exclusive property of the Company.

12. SERVICE AVAILABILITY

The software is offered "AS IS" and "AS AVAILABLE". The Company does not guarantee uninterrupted operation, absence of errors or continuous availability.

13. PRIVACY

Use of the service is subject to the Privacy Policy, available at: traderpilot.net/privacy

14. MINIMUM AGE

The User must be at least 18 years old.

15. PROHIBITED USE

The User must not use the service for:

• Illegal activities
• Market manipulation
• Fraud
• Regulatory violations

16. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, USA.

17. DISPUTE RESOLUTION

Any dispute shall be resolved by binding arbitration in Florida. The User waives class actions and jury trials.

18. MODIFICATIONS

The Company may modify these Terms at any time.

19. ACCEPTANCE

The User declares that they have read these Terms, fully accept them and understand the associated risks.
